Checklist

Closing upon Adult’s Death

  1. Fill out the following forms:
    i. PC 634, Annual Report of Guardian on Condition of Legally Incapacitated Individual (indicate on the form that this is a final report).
    ii. Include a photocopy of the ward’s death certificate.

    Important Note: You MUST use this form; you cannot draft your own document.

  3. Submit your completed documents to the Judge of Records office in the following order (as one PDF if submitting electronically):
    ii. PC 634, Annual Report of Guardian on Condition of Legally Incapacitated Individual
    ii Photocopy of ward’s death certificate

  4. There is no Filing Fee

  5. Upon receipt of these documents the case will then be closed by the Court.

Closing Adult Guardianship BEFORE the Ward’s Death

Note: A request to modify or terminate an adult guardianship may be made by an informal letter from the ward. Anyone else interested in the ward’s welfare must file a Petition to Terminate/Modify.

  1. Fill out the following forms:
    i. PC 675, Petition Terminate\Modify Guardianship

    Note: Addresses of all interested persons must be listed on petition. If missing addresses for any interested persons, after you receive the hearing information, you must arrange for publication. Click here for more information.

  3. Submit your completed document to the Court (as one PDF if submitting electronically):
    ii. PC 675, Petition to Terminate\Modify Guardianship

  4. Filing Fee

    Note: If the ward is the petitioner there is no fee.

    i. $20 Filing Fee
    ii. If you file electronically or by fax, you will receive a notification to pay with the amount of your total fees, once your filing has been accepted.
    iii. Fees can be paid:

    1.) electronically via ePayment online or
    2.) via mail by CHECK (no out-of-state checks)or MONEY ORDER
    3.) Make checks payable to: “Wayne County Probate Court”
    4.) Mail checks/money order along with a letter with your case # referencing what the payment is for to:

    iv. A fee waiver request can be submitted together with your petition. Click here to learn about the fee waiver process.

    Note: Once accepted for filing refunds will not be given.
  5. Hearing Date
    i. Once fee is paid you will be sent notice of hearing information, including ZOOM instructions.
    ii. You must serve a copy of the petition and the hearing information on all the interested persons.
    iii. All hearings are being conducted by ZOOM.
    iv.You must attend the ZOOM hearing or your petition will be dismissed.

  6. Guardian ad Litem
    i. By law, the court must appoint a Guardian ad Litem (GAL) to represent the interest of the alleged legally incapacitated individual unless the person has their own attorney.
    ii. The GAL must visit the person and make a recommendation as to whether or not a guardian is still needed.

    Note: If the ward is the person petitioning to terminate the guardianship, no GAL is appointed; instead a lawyer is appointed to represent the ward if they do not have their own attorney.

    iii. The GAL is not an employee of the court but a licensed practicing attorney appointed by the court.
